Employment Practices Liability Insurance (EPLI)

Employment practices liability insurance, also known as EPLI, is a type of insurance that protects businesses from legal liability for employment-related claims. These claims may include allegations of discrimination, harassment, wrongful termination, breach of contract, and other employment-related issues. A wrongful employment practices claim, even if false, can disrupt business, hurt morale, damage your reputation, and potentially lead to financial damages.

EPLI typically covers a range of claims, including:

  • Discrimination: EPLI covers claims alleging discrimination based on factors such as race, gender, age, religion, and disability.
  • Harassment: EPLI covers claims alleging sexual harassment, racial harassment, and other forms of workplace harassment.
  • Wrongful termination: EPLI covers claims alleging that an employee was terminated without just cause or in violation of the terms of their employment contract.
  • Breach of contract: EPLI covers claims alleging that an employer breached the terms of an employment contract.
  • Retaliation: EPLI covers claims alleging that an employee was retaliated against for exercising their rights or reporting misconduct.

EPLI can provide several benefits to businesses, including:

  • Financial protection: EPLI can help to cover the costs of defending against employment-related claims, including legal fees, settlements, and judgments.
  • Reputation protection: EPLI can help businesses protect their reputation by covering the costs of defending against employment-related claims and managing the public relations fallout.
  • Timely responses to lawsuits: Employers being sued by their employees is common, and being prepared is vital.
  • Access to Legal Help: EPLI often provides access to legal resources, providing you the advice you need quickly.
  • Risk Management Strategies: Access to risk management and human resources consulting can help avoid a claim altogether.
  • Additional protection for Directors and Officers: While D&O insurance can defend against employment-related lawsuits, having an EPLI policy ensures the limits of your D&O policy are not exhausted unnecessarily.

EPLI may be a good option for businesses of all sizes and types, particularly those that are at higher risk of employment-related claims. For example, businesses in industries with a high risk of discrimination or harassment, such as the hospitality industry, may benefit from EPLI. Additionally, businesses with a large number of employees may also be at higher risk of employment-related claims and may want to consider EPLI as a way to protect against these risks.
